Question #1 (5 points):

Joey is suing Brandon Corporation for negligence because its delivery truck hit him while he was crossing the street. List in bullet form and explain the five elements that Joey must prove to establish liability.

Question #2 (5 points):

Your boss heard that a competitor is aggressively using data mining in its marketing. She doesn’t know much about it, so she calls you into her office one day and asks you to prepare a three bullet point memo explaining to her (1) what is data mining and what tools are used in data mining, (2) how data mining is used by marketers, and (3) what ethical issues are raised because of its use. What do you write?

Question #3 (5 points):

Your boss also heard that this competitor is aggressively using commercial email campaigns. She knows that there is a CAN-SPAM Act but doesn’t know much about it. She asks you to write a bullet point memo detailing (1) the requirements for commercial emails, (2) how your company can avoid these requirements, and (3) whether, according to the experts, these requirements have been effective.
